Terms and Conditions

General terms and conditions (GTC) for Hall of Arts
“Hall of Arts” is an online service (app/platform) on which app users have the opportunity to search for artists and event business partners, access their profiles and view contributions online in the form of videos and photos, and participate in interactive creative challenges. Conversely, artists and business partners have the opportunity to present themselves on Hall of Arts by means of a profile and to accept booking or cooperation requests.


The Hall of Arts app is provided by AP Entertainment GmbH, Tiefer Graben 7/16, 1010 Vienna, office@hall-of-arts.com, company register number: FN 645437 y, commercial register court: Vienna operated (hereinafter referred to as “Hall of Arts”). Hall of Arts includes both the main domain “hall-of-arts.com”, as well as any connected subdomains and/or other integrated domains and applications.

The various parties are referred to below as follows:

  • “User” = all natural or legal persons who visit/use the app or website.
  • “Viewer” = all natural or legal persons who visit/use the app or website without having registered via a profile.
  • “Artlovers” = natural or legal persons who use the website for information purposes, to search for artists or business partners and/or to obtain services for art lovers from Hall of Arts.
  • “Business partners” = natural or legal persons (usually entrepreneurs) from the art and creative industries as well as event service providers who operate or want to operate a business partner profile on Hall of Arts or want to use the platform for advertising purposes.
  • “Artists” = creative people from the fields of music, painting, dance, entertainment, photography & videography as well as fashion, design & styling who run or want to operate an artist profile on Hall of Arts.
  • “Provider” = collective term for “artist” and “business partner” summarized.

These terms and conditions govern the contractual relationships between Hall of Arts and the parties listed above and apply to them. Deviating conditions are not recognized and are generally considered mutually agreed upon with the use of the app, unless Hall of Arts expressly agrees to the validity of different terms and conditions in writing.

The terms and conditions consist of the “General Terms and Conditions for all Users (1.)”, which apply to all parties, as well as the “Additional Terms and Conditions (2., 3., 4., 5.)”, which apply in addition to the above-mentioned specific parties.

  • “Consumer” or “consumer” within the meaning of these terms and conditions is any natural person who concludes a legal transaction for purposes which for the most part cannot be attributed to their commercial or independent professional activity.
  • “Entrepreneur” within the meaning of these terms and conditions is any natural or legal person or partnership with legal capacity that concludes a legal transaction as part of their commercial or independent professional activity.


For reasons of better readability, only the masculine form is used in these terms and conditions. However, all genders are always meant equally.


In addition, our data protection regulations apply to all parties, which form a binding part of the contractual relationship.

1. GENERAL TERMS AND CONDITIONS FOR ALL “USERS”

1.    Registration and usage
Using the Hall of Arts app generally requires prior registration and login in order to be able to use all interactive functions such as publishing content, placing likes or commenting.
Access to publicly available content (e.g. contributions, videos) is also possible without registration in a passive role as a so-called “viewer”. However, interaction features are not available in this mode.


2.    User profiles and contract types
Different profile types can be selected during registration:

  1. Artist profile: Registration as an artist is generally free of charge. Artists get access to the app's basic functions and can also activate an extended service package by taking out a paid premium subscription. The respective services and fees are regulated in the current service description.
  2. Artlover profile: Users who do not want to create or publish content themselves, but want to actively engage with artists and their contributions to Hall of Arts, can register as Artlovers. This profile makes it possible to follow artists, like and comment on contributions and actively support the community — without being artistically active yourself. The use of the Artlover profile is free of charge.
  3. Business partner profile: Registration as a business partner is for the purpose of presenting your own company or brand on Hall of Arts. Business profiles are subject to a paid basic contract regardless of an upgrade. The exact contents and prices are set out in the currently valid price list and service description.


3.    Conclusion of contract
The contract between the user and the operator of Hall of Arts is concluded by completing the respective registration process and accepting these general terms and conditions. In the case of paid variants, the contract is also concluded upon confirmation of the respective booking subject to payment by the user.


4.    Content, quality and accuracy of the profiles
Hall of Arts is an entertainment and information platform with a search function to search for artists and event business partners and offers information about them. The artist or business partner profiles, or their content, are created by the providers themselves; Hall of Arts assumes no liability for the content, accuracy and completeness of the information provided by the providers, as well as for their quality or professionalism. Hall of Arts also does not guarantee the actual identity of the providers, or their legal or business form, as there is generally no content or editorial control. The contracts subsequently concluded between the parties involved as a result of networking on the app are concluded exclusively directly between the respective contracting parties (e.g. artists and business partners); Hall of Arts does not become a contracting party or other party to these contractual relationships.
In addition, Hall of Arts regularly offers interactive elements such as challenges and auditions, in which all user groups that have a registered profile (i.e. excluding viewers) can participate. This includes challenges and auditions in particular.


5.    Challenges
Hall of Arts organizes challenges in which all user groups — with the exception of viewers who do not have their own profile — can submit artistic contributions on a given topic. The winners of challenges are determined by community voting or a jury. Hall of Arts reserves the right to define and change the specific participation conditions for the respective challenges in detail.


Unless a different process or other conditions are set by Hall of Arts for individual challenges, the basic sequence of the challenges is as follows:


5.1    Procedure and submission

  • The theme of each challenge is determined by Hall of Arts and announced on the platform.
  • Participants can submit artistic contributions in the form of images and videos that match the given topic.
  • The evaluation criteria are set and announced by Hall of Arts.
  • Submission is made via the function provided on the platform within the specified period.
  • Each participant may only submit one entry per challenge, unless there are other rules.
  • Hall of Arts reserves the right to reject contributions that violate applicable law, good decency, terms of use, or Hall of Arts values.
  • The winners of the challenges are determined by community voting or by a jury.

5.2     Rights and obligations of participants

  • By participating in a challenge on the Hall of Arts platform, the participant agrees that the content uploaded by him (in particular photos and videos) as part of his participation is publicly available to all users of the platform. If the participant withdraws their participation, the content uploaded as part of the participation will also be deleted.
  • The participant guarantees that he is the author of the submitted contribution and/or has all necessary rights.
  • The participant grants the organizer the right to use the submitted contribution as part of the challenge and to promote the platform (e.g. on the platform, on social media, in press releases).
  • The participant agrees that their contribution including name/pseudonym will be published in connection with the challenge and will be publicly available and receive votes for the duration of the challenge.
  • The participant undertakes not to submit any contributions that violate the rights of third parties, are insulting, discriminatory or otherwise inappropriate.
  • Hall of Arts haftet nicht für technische Störungen oder Ausfälle der Plattform, die die Teilnahme an den Challenges beeinträchtigen.  
    The personal data of participants collected as part of the challenges will be processed in accordance with the organizer's privacy policy.
    With regard to any third-party claims that should be brought against Hall of Arts on the basis of the submitted contribution, the respective participant will hold Hall oft Arts completely indemnified and indemnified.

6.    Castings
Hall of Arts allows all user groups — with the exception of viewers who do not have their own profile — to participate in online auditions.
By participating in public auditions on the Hall of Arts platform, the user agrees that the content uploaded by him as part of his application (in particular application videos) is publicly available to all users of the platform. In the case of private auditions, i.e. those that are only made available to selected groups of people (e.g. organising entrepreneurs), the application content is made available exclusively to the organising company and is not subject to public inspection.
In both cases (public and private auditions), the participant agrees that his contact details may be passed on to the advertising company in the event of a job confirmation and that he can be contacted by this company.
Legal notice on auditions: Participation in auditions and the acceptance of job offers by persons who have not registered themselves may have legal and tax consequences. Users themselves are responsible for meeting their legal obligations. We accept no liability for any resulting problems.


7.    Bookings - Presentation of artist availability / offer of the provider
The availability of artists shown on Hall of Arts is only an initial guide. It does not represent a binding commitment or guarantee of the actual, current availability of the respective artist, which is ultimately at the discretion of the respective artist. In order to obtain binding information on current availability, the specific offer and the conditions for an engagement or assignment, it is necessary to contact the respective artist directly and make an individual agreement.
Hall of Arts assumes no responsibility for the accuracy or timeliness of the availability information provided by artists.


8.    Contractual relationship between provider and user
Contracts for artistic services are concluded exclusively between the user and the respective artist or business partner. Hall of Arts is not a party to and assumes no responsibility for the performance or failure to fulfill such contracts. Hall of Arts is not liable for any breaches of contract, disputes or damages arising from the direct contractual relationship between artist and user.
Hall of Arts only provides the platform, but is not involved in processing contracts.


9.    Badge system (“star”):
Hall of Arts uses a badge system in the form of stars to visually highlight specific user profiles.


9.1    Silver star (premium badge):
The silver star marks users who have taken out a paid premium subscription. This badge is displayed for the duration of the active subscription and indicates the extended range of functions and the supporting contribution to the platform. This is a paid highlighting, not a quality rating or editorial recommendation. The badge is not a sign of quality and does not include an assessment of artistic abilities or services offered.
The assessment of the quality and suitability of an artist is exclusively at the discretion of the users. Hall of Arts expressly recommends that you obtain detailed information about the respective artist before you commission.
The star badge is to be understood as a paid advertising service.

9.2    Golden Star (Artistic Badge):
The golden star is awarded to users who have distinguished themselves through special creative achievements, active participation in platform challenges or other defined quality criteria. The award is made by Hall of Arts at its own discretion on the basis of transparent, publicly available criteria. This badge is not available for purchase and is intended to recognize artistic quality and community commitment.

9.3    Hall of Arts reserves the right to change the criteria for awarding or displaying badges at any time and to withdraw badges if their requirements are no longer met or if the platform guidelines have been violated.

10.    How to contact us
Hall of Arts provides the contact information voluntarily provided by artists on the platform (e.g. email addresses, social media links, or telephone numbers). The use of these communication channels is the sole responsibility of the respective user.
Hall of Arts assumes no liability for the content, functionality or security standards of external communication services or linked websites. The respective usage and privacy policies of the third-party providers apply.
Users are responsible for finding out about the security, data protection practices and seriousness of the chosen communication channels before contacting them.

11.    Availability Website / Data
Hall of Arts strives to keep the platform permanently accessible and functional. However, no guarantee can be given for trouble-free, uninterrupted or always available use.
In particular, maintenance work, technical adjustments or unforeseen system failures may result in temporary restrictions or shutdowns — even without prior notice.
Hall of Arts assumes no liability for loss of data, incorrect transmissions or other damage caused by technical problems, connection problems or failures, unless there is gross negligence or intent.

12.    Payment processing, service changes and discontinuation of services

12.1     Payment methods and processing:
Payments for paid Hall of Arts services can be made using the payment methods currently offered on the platform. Hall of Arts reserves the right to change or supplement the available payment methods at any time or to temporarily suspend individual payment methods.

12.2     Invoicing:
Invoicing is generally carried out electronically. Invoices are either sent by email to the address stored with the user account or made available directly in the user account.

12.3     Price details:
All prices shown on the platform include applicable taxes (in particular value added tax, where applicable).

12.4     Modification and discontinuation of services:
Hall of Arts reserves the right to adapt, expand, restrict or completely discontinue the content of the platform and its content, functions and services offered at any time. Hall of Arts is also entitled to transfer the platform and all associated rights and obligations to third parties.

12.5     Discontinuation of chargeable services:
If a paid service — such as a premium subscription — is permanently discontinued, Hall of Arts will either continue to provide the contractually owed services until the end of the billing period already paid or refund the amount not used on a pro rata basis.

Further claims — in particular for compensation — are excluded to the extent permitted by law.

13. Illegal or abusive use and content
Any misuse of Hall of Arts Platform data, whether knowingly or unknowingly, is strictly prohibited. Users agree not to use the Hall of Arts app and its services for illegal or abusive purposes. In particular, it is prohibited to publish, store, transmit or make available to third parties prohibited by law content on the platform.
In the event of infringement, Hall of Arts is entitled to block the user account immediately and without warning. Users are entirely responsible for the content they provide and their activities, including the actions of third parties attributable to them.
Hall of Arts will remove illegal content immediately after becoming aware of it. Hall of Arts assumes no responsibility whatsoever for the accuracy, legality, appropriateness, or compliance with copyright regulations with regard to content published by providers. Hall of Arts” reserves the right to remove pages or links without notice if they violate applicable laws, legal norms, common decency or the values of Hall of Arts or if there is a corresponding suspicion.

14. Force majeure and technical faults
Hall of Arts is released from its obligations to properly operate the platform when force majeure events occur, such as labor disputes, natural disasters, network failures, computer damage, or hacker attacks.
Hall of Arts assumes no liability for errors, faults or damage due to improper operation, faulty interfaces, lack of IT security or outdated software on the part of the user.

15. Third party license terms
If software is made available whose license holder is a third party, the granting of the right of use is based on the license terms of the license holder.

16. Prohibited advertising and use by competitors
The use of the Hall of Arts platform and associated social media channels for commercial or advertising purposes is only permitted within the framework of advertising formats expressly offered and approved by Hall of Arts.
Any other commercial use — in particular without the prior written consent of Hall of Arts — is prohibited.
The use of the platform to directly or indirectly promote competing services, companies or platforms is also prohibited. This applies regardless of whether the application is publicly visible or obscured.

17. Labeling paid advertising
Certain offers, links, and content on Hall of Arts may represent paid advertising. If required by law, this will be marked accordingly.
Hall of Arts reserves the right to add missing identifiers to content provided by the provider.

18. Disclaimer and compensation

18.1 Liability towards consumers
Hall of Arts is only liable to consumers for damage caused by grossly negligent or intentional conduct. This does not apply to personal injuries, which are liable even in the event of slight negligence.

18.2 Liability towards entrepreneurs
Hall of Arts is only liable to entrepreneurs in the event of grossly negligent or intentional breach of duty. Here, too, personal injuries are excluded from this restriction.

Compensation claims from entrepreneurs must be made within 6 months of becoming aware of the damage and the person causing the damage. They expire no later than 5 years after provision of the respective service, regardless of knowledge.

18.3 Extension of liability to third parties
The above limitations of liability apply equally to all employees, representatives and vicarious agents of Hall of Arts.

19. Amendment to the terms and conditions
Hall of Arts reserves the right to change these terms and conditions at any time. Users will be notified of changes by email and on the platform at least 14 days before they come into effect.
Users who continue to use the platform after the changes come into force agree to the amended terms and conditions. Users who object to the changes must do so in writing within 14 days of notification. An objection leads to the termination of the user agreement.

20. Invalid provisions/amendments
Should individual provisions of these terms and conditions be or become invalid, the effectiveness of the remaining provisions remains unaffected. The invalid provision will be replaced by a valid provision that comes closest to the economic purpose of the invalid provision. Amendments and additions to these terms and conditions must be made in writing.

21. Governing Law/Jurisdiction/Contract Language
Austrian law applies to all legal relationships between Hall of Arts and users. Only Austrian law applies to entrepreneurs, excluding the UN sales law. The place of jurisdiction for all disputes is 1010 Vienna, to the extent permitted by law. Hall of Arts reserves the right to choose another admissible place of jurisdiction. The contract language is German.

22. Dispute resolution and consumer dispute resolution
The European Commission provides a platform for online dispute resolution (OS), which is available at https://ec.europa.eu/consumers/odr/. Consumers have the option to use this platform to resolve their disputes. Hall of Arts is prepared to participate in dispute resolution proceedings before a consumer arbitration board

2. ADDITIONAL TERMS AND CONDITIONS FOR “ARTLOVER”

1st definition
Artlovers are organizers or other natural persons or companies who use the website for information purposes, to search for artists or business partners and/or to obtain services for art lovers from Hall of Arts.

2. Object of the service
The services that Hall of Arts provides to Artlover (such as creating a profile and using the app for entertainment purposes) are generally free of charge. One paid service that can be used as an option by Artlovers is the option to support their favorite artists via the app (for example through the booster function).

Artlover can view artist profiles and artist contributions, like, share, comment on content, send booking requests and participate in challenges or auditions. However, they cannot publish their own posts but can support their favorite artists by boosting their contributions and help them get more publicity.

Viewer Those who do not have their own account can only view the content of the app, but cannot be interactive in any way.  

3. Direct contractual relationships and disclaimer
At Hall of Arts, all contracts for artistic services are concluded directly between the artlover and the respective artist. Hall of Arts is not a party to these contracts.

Hall of Arts therefore assumes no liability for breaches of contract, disputes or damages arising from the direct contractual relationship between artist and Artlover.

4. Referral service
The Hall of Arts recommendation service is exclusively intended to provide non-binding assistance in finding suitable artists for specific events or projects. There is no legal obligation to successfully mediate or make certain artists available.

Individual offers that Hall of Arts transmits to Artlover or other users as part of this service are subject to change and non-binding unless there is a written confirmation from the respective artist or a mutually signed contract between the parties involved.

Bookings and engagements made on the basis of the referral service are subject exclusively to the terms of the respective artist contract concluded between the mediated artist and the client.

3. ADDITIONAL TERMS AND CONDITIONS FOR “PROVIDERS”
Providers are either artists, companies in the arts and cultural industries, or event business partners. Therefore, the provisions in Sections 4 and 5 and the General Terms and Conditions apply to all users (Section 1) in addition.
Vendors expressly confirm that they are entrepreneurs. The provisions of the Consumer Protection Act (KSchG) are therefore not applicable to the contractual relationship between Hall of Arts and providers.

1. Scope of service
The purpose of Hall of Arts' services is the provision of the online platform and the maintenance of the platform. Additional services can only be agreed upon by additional agreement or booking.

2nd auditions
Cooperation partners have the opportunity to advertise castings at Hall of Arts and to award jobs to artists. Providers who advertise online auditions via the Hall of Arts platform are required to clearly and clearly identify the type of casting (public or private).

In the case of public auditions, the providers agree that the application content uploaded by the applicants (in particular application videos) can be viewed publicly by all users of the platform for the duration of the casting. In the case of private auditions, providers agree to keep the application content confidential and not to pass it on to third parties without the consent of the applicants.

Providers are entitled to use the contact details of applicants who receive a job offer to contact them and process the job assignment.

The providers are solely responsible for the legal and tax processing of job assignments that are awarded as part of auditions. Hall of Arts assumes no liability for any resulting problems. The providers commit themselves to comply with the applicable data protection regulations and to inform applicants about the processing of their personal data as part of the casting process.

3. Right of use
Hall of Arts grants providers a non-exclusive, non-transferable right of use for the booked functions of the platform after full registration. All other rights to the platform remain with “Hall of Arts”.

4. Subscriptions and terms
Users have the option to take out paid premium subscriptions (“subscriptions”) to unlock advanced features and services of the Hall of Arts platform. The subscription models, prices, services and terms available in each case are based on the service description valid on the platform at the time of booking.

5. Conclusion of the subscription contract
The subscription contract is concluded as soon as the user selects a premium model on the platform, enters the payment information and completes the booking process by clicking on the “Subscribe now for a fee” button. The contract becomes effective upon confirmation by Hall of Arts.

6. Duration and extension
Premium subscriptions are — unless otherwise stated — concluded with a fixed minimum term of one month and are automatically extended by the selected term unless cancelled in good time.

7. Termination
Subscriptions can be canceled at any time up to 24 hours before the end of the current period via the user account. If no timely cancellation is made, the subscription is automatically extended for the previous term. A pro rata refund in the event of early termination is excluded, unless otherwise provided by law.

8. Payment terms
The subscription fees must be paid in advance for the respective term. Payment is made using the payment methods offered on the platform. The user is obliged to ensure adequate coverage and up-to-date payment details.

9. Amendment to the scope of benefits
Hall of Arts reserves the right to adapt, further develop or change the content and functions of premium subscriptions, provided that this does not affect the essential purpose of the contract. Users will be informed in good time about significant changes.

10. Protection of access data
Providers must keep their login details secret and inform Hall of Arts in case of unauthorized access. Passwords must be at least 8 characters long, comply with current security standards and be changed regularly. Passwords may not be used for multiple applications or shared with third parties.

11. Rejection and termination by Hall of Arts
Hall of Arts reserves the right to reject registrations or provider profiles without giving reasons. Hall of Arts can also block, delete or extraordinarily terminate the user contract at any time and with immediate effect in the event of violations of these terms and conditions, late payment, illegal conduct or misuse of the platform.

In the event of justified termination without notice by Hall of Arts, there is no right to a refund of fees already paid. Otherwise, unused services will be refunded on a pro rata basis.

Notification of termination is usually sent by email to the email address provided by the provider.

12. Deleting the profile by the provider
Providers can delete their user profile independently via the user account at any time and without giving reasons or request deletion in writing by e-mail to office@hall-of-arts.com.

Hall of Arts will usually delete the request within 14 days of receipt of the request.

There is no right to a refund of subscription fees or services already paid but not fully used in the event of voluntary profile deletion, unless legal regulations provide otherwise.

Both parties reserve the right to extraordinary termination at any time. The deletion of the profile is also considered the termination of the user agreement and — if applicable — of the premium subscription.

Hall of Arts is entitled to delete fake accounts, duplicate registrations or obviously illegal profiles immediately and without notice.

13. Quality standards for images and profiles
To ensure high quality and an appealing user experience on the Hall of Arts platform, all postings must meet the following minimum requirements:

  • Content must have sufficient resolution and image quality (at least Full HD recommended)
  • Images and videos must not contain annoying watermarks, annoying borders, or blurry/image noise.
  • Content must be free from unlawful, offensive, discriminatory, or otherwise inappropriate motives.
  • Copyrights and rights of use must be secured by the user; third-party content may only be used with express permission.

Should content or profiles not meet the requirements, Hall of Arts reserves the right to inform users to remove content in whole or in part, or
to refuse to publish profiles or to take them offline afterwards.


14. Admissibility of content, third-party rights and copyright
The provider must check the content provided by it for legal, in particular competition, trademark, copyright and administrative law, and assures that it does not infringe the rights of third parties. Hall of Arts is not liable for the legal admissibility of content provided by the provider or by third parties. The legal clarification (image rights, music rights, model rights,...) is carried out solely by the provider. The provider indemnifies Hall of Arts in this regard and includes any costs for legal defense.

Illegal or immoral content, political statements, discriminatory, racist or misogynistic content, and advertising for third-party products and services are prohibited.

14.1 Accuracy of information
Providers are committed to providing accurate and complete information. Providers are responsible for updating their data themselves.

14.2 Submitted content and editorial interventions
Content is uploaded, transmitted and published on the platform by the providers themselves. Content or editorial control by Hall of Arts does not or does not necessarily take place.

Hall of Arts has the right to adapt, change or edit the data provided by the provider (images, videos, texts, descriptions, contact details, etc.) as required. Furthermore, Hall of Arts is free to reject unsuitable content and to remove it without notification. In principle, Hall of Arts has the right to intervene in the provider's profile information at any time, in particular if, in the opinion of the editors, these are incorrect (e.g. genre selection, suitability for certain events, etc.) or incomplete and as a result, for example, falsify the search results, or the like. Even though such an assessment is always subjective, the final assessment is made by Hall of Arts and in no way entitles you to reimburse paid services or to any compensation claims.

15. Services offered and power of attorney
Each provider is obliged to actually be able to provide users with the services they offer on Hall of Arts. If the provider fails to provide the services it offers at least twice and therefore there are corresponding complaints from customers, Hall of Arts is also entitled to terminate the contractual relationship with the provider, to block the booking function for this profile and/or to completely delete the profile. Profiles may only be created for your own group of artists, your own company or a company for which the provider is authorized to represent. When representing other artists or companies, the provider must have the appropriate power of attorney.

Providers release Hall of Arts from third-party claims based on content as well as from claims, damages and claims due to violations of terms and conditions or legal provisions.

16. Right to use data and content
Providers grant Hall of Arts an unlimited right to use their content, which can be revoked at any time. The right of use includes the storage, publication, adaptation, formatting, processing and transfer of content. Providers are aware that technical processing and transmission requires the transfer of content via various systems.

Providers give Hall of Arts permission to use their data and content for advertising purposes. This includes use on the platform, by third parties and in print media. Providers can object to this use in writing.

17. relationship between provider and end customer
Hall of Arts is neither a representative of the users nor the provider and, apart from these general terms and conditions, is generally not in any contractual relationship with the users and is therefore not responsible for misconduct, damage or breaches of contract between providers and users. When booking via the Hall of Arts consulting service, the individually agreed conditions between the user and the provider apply regarding this individual request.

18. Publication of profile data/use of content by third parties
Providers are aware that their data on the platform is publicly available worldwide. Hall of Arts is not liable for unauthorised use of data by third parties.

19. Data protection and contact by Hall of Arts
Vendors agree that their activities may be recorded, stored, and analyzed when using the platform for platform improvement, performance analysis, and promotional activities related to Hall of Arts. Further information on data protection can be found in the Hall of Arts privacy policy.

Providers and their employees are committed to complying with data protection regulations, in particular when using user data or information that becomes known through the use of Hall of Arts.

Hall of Arts is entitled to inform providers by e-mail about important innovations, system adjustments, technical changes, security warnings and changes to the terms and conditions.

20. Prices and price adjustments for subscription models

20.1 Validity of prices
The current prices for paid subscription models (e.g. premium subscriptions) are based on the current price list on the Hall of Arts platform at the time the contract is concluded. All prices include the applicable statutory value added tax, unless otherwise stated.

20.2 Price changes upon renewal
Hall of Arts reserves the right to adjust the prices for subscription models with effect for future billing periods. Such a price adjustment will be announced to the user at least 30 days before it comes into force by e-mail or by notification in the user account.

20.3 Right to object in case of price adjustment
In the event of a price change, the user has a special right of termination. The user can cancel the subscription no later than when the price adjustment comes into force. If no timely cancellation is made, the price adjustment will be considered accepted and the subscription will continue under the new terms.

20.4 No retrospective price changes
Price changes only affect future billing periods. Charges already paid for current subscription periods remain unaffected.


21. Payment methods and terms of payment

  • Payments are to be made without deductions of discounts or other discounts, unless otherwise agreed.
  • When using financial institutions or payment service providers, their terms and conditions and data protection notices apply.
  • Providers must ensure that they meet the requirements (e.g. covering accounts) for a successful payment.
  • In the event of failed or rescinded payments due to errors on the part of the provider, the provider bears the fees incurred.
  • In the case of credit card payments, the credit card details are provided when ordering and the card is charged after authorization.
  • Costs for reminders will be charged to the provider.
  • Hall of Arts is entitled to claim default interest at the statutory rate as well as other consequences and costs determined by law from the defaulting providers. The provider's obligation to pay default interest does not preclude further claims by Hall of Arts. Damages caused by delay include costs of law enforcement, such as costs for legal advice, dunning proceedings or debt collection.

22. Promotional vouchers/promo codes

  • Promotional vouchers are vouchers issued free of charge, e.g. for discounts.
  • Promotional vouchers can only be redeemed under the specified conditions and within the specified period.
  • As a rule, promotional vouchers cannot be combined with other vouchers and are not transferable.
  • Promotional vouchers can only be redeemed before completing the order process.
  • If, after redeeming a promotional voucher, an amount remains to be paid, this can be paid using the payment options offered by Hall of Arts.
  • If a promotional voucher exceeds a service value, it will only be considered up to the value of the goods, without the remaining amount being paid out.

23. Copyright and rights of use

  • Hall of Arts services and products are protected by copyright.
  • Providers receive a simple right of use for purposes in accordance with the contract.
  • The reproduction, distribution or making publicly available content protected by copyright is prohibited.
  • Copyright notices must not be removed.
  • In the case of third-party user licenses, their terms apply before these terms and conditions.
  • If payment is made in advance by “Hall of Arts”, rights of use will only be granted after full payment.

4. ADDITIONAL TERMS AND CONDITIONS FOR “BUSINESS PARTNERS”
The purpose of Hall of Arts' services is to provide advertising space on Hall of Arts as well as paid business partner profiles.

“Business partners” are always also “providers” and “users” and therefore the “Additional Terms and Conditions for Providers” according to Section (3.) and the General Terms and Conditions for all “Users” (according to Section 1.) apply in addition.


1. Business partner profile
Business partners can create business profiles themselves and upload their data via the platform. Business partners create their profile in accordance with the “Hall of Arts” guidelines and fill it with their own content. The information entered is displayed in a public profile. If the information provided by the business partner meets the other users' search criteria, the profile is displayed in the search results.

The business partner profile consists of mandatory and voluntary information. Mandatory information is marked. Without this information, profiles cannot be published. The data entered and uploaded in the “Profile” area is displayed in a public profile and is accessible to everyone on the Internet. Business partners have access to the information they have stored at any time and can update their data themselves via the profile in the app.

2. Profile fee and due date
The agreed fee is due before publication or before the start of the subscription period, unless otherwise agreed. For promotions with a free subscription period, the subscription fee must be paid after publication. The paid period starts after the free period has ended.

3. Placement and visibility on the platform
The online presence for business partners in certain areas of Hall of Arts, such as the homepage, is not permanent, but in rotation with other providers. Other criteria that affect the online presence include the timeliness and popularity of the contributions.


4. Marketing and advertising placements
Hall of Arts offers various marketing and advertising options for business partners:

  • Sending company-related offers (e.g. discounts) to suitable target groups via push notifications and ads in the piggy bank category.”
  • Placement of comparative questions as a marketing tool (price depends on duration and target group size).
  • Presence in location and partner search as well as in checklists (e.g. for wedding planning).
  • Mention by name as “top company” in checklists.

Hall of Arts reserves the right to change, adapt, expand, remove, or discontinue the platform, its services, content, and features at any time. If a paid service (e.g. annual subscription) is discontinued, Hall of Arts will either provide the paid service by the end of the billing period or refund the pro rata, unused amount. Further claims for damages are excluded.

5. ADDITIONAL TERMS AND CONDITIONS FOR “ARTISTS”
“Artists” are always also “providers” and “users” and therefore the “Additional Terms and Conditions for Providers” according to Section (3.) and the General Terms and Conditions for all “Users” (according to Section 1.) apply in addition.


1. Definition of “artist”
“Artists” at Hall of Arts include bands, musicians, dancers, painters, photographers, models and fashion designers as well as show and entertainment artists from the event sector. Hall of Arts is solely responsible for deciding which types/genres are included by artists and for which corresponding categories are made available. The same applies to the decision as to which services fall under the category of “artists” and which fall under the category of “event service providers”.

2. User account and range of services
The use of “Hall of Arts” as an artist requires the creation of a user account. A valid email address and password are required to set up the user account. Providers are responsible for using a secure password that meets current security standards and protects against unauthorized use.

Artists can present themselves and their works by creating a profile and publishing contributions, they can network with other users and receive booking requests. Particularly popular posts are highlighted on the homepage under the title “Superstars.” By using the booster function, contributions in the respective category are pre-ranked for a specific period of time. Artists can also take part in challenges and castings online via the app.

Legal notice:
All Hall of Arts artists are responsible for ensuring that the content they publish — such as texts, images, videos, music or other creative contributions — does not infringe the rights of third parties, in particular no copyright, intellectual property or personal rights. In particular when publishing content such as music covers, samples, third-party image material or other protected works, artists are required to obtain all necessary usage rights independently in advance.
Hall of Arts assumes no liability for content uploaded by third parties and does not act as a reviewer or rights user. If legal violations become known, Hall of Arts will immediately remove the corresponding content (“Notice and Takedown”).

3. Booking inquiries and contact details
Hall of Arts offers artists the opportunity to accept booking requests. If an artist does not want to accept booking requests, this function must be deactivated when creating the profile. Artists can also deactivate this function at any time later via the settings. Booking requests on Hall of Arts may only be made via the “Send booking request” function. It is therefore not allowed to provide contact details or similar information in profile text, image, content or elsewhere. Hall of Arts will immediately delete such content without notice. In the event of an infringement, Hall of Arts has the right to immediately cancel the user agreement, although any fee already paid will not be refunded.

Legal notice:
Hall of Arts simply provides a technical platform through which providers (e.g. artists, creatives) and customers (e.g. organizers, private individuals, companies) can contact each other and conclude contracts. Hall of Arts is not itself a party to these agreements and assumes no responsibility for the content, implementation or payment of the services provided via the platform. All artists who regularly accept bookings through Hall of Arts act on their own responsibility and are considered legally self-employed. They are solely responsible for duly taxing their income, meeting any social security obligations and complying with all other legal obligations (e.g. registration with the tax office or social security). Hall of Arts assumes no control or advice obligations in this regard.

4. Contact options for users
Users can request the artist using the “booking function” stored in their profile. Inquiries via the enquiry form are sent by Hall of Arts as a push notification to the respective artist and sent by email to the email address provided by the provider. After a booking request has been activated, the user is shown further contact options (e-mail, telephone number). The artist undertakes to provide correct information here. Providing or forwarding to value-added numbers, destinations with higher costs or damage to the user, or goals that are not related to the artist profile is prohibited. The artist indemnifies Hall of Arts in this regard and includes any costs for legal defense.

5. Artist profile
The data for the artist profile can be entered or uploaded to the account by the artist himself, the data entered is then displayed in a public profile that is accessible to everyone and can be updated at any time. If the artist's information meets specific search criteria, the profile is displayed to the user in his search results. New posts are published on the homepage and are also publicly available.
The artist profile consists of mandatory and voluntary information. They are queried when created and can be edited later. Mandatory information is marked; without this information, the profiles cannot be published.


6th calendar
The “Calendar” area is used by the artist to manage his appointments. The availability of the artist is shown in the search, and the user can also view the artist's entire calendar overview.
The artist's calendar settings currently have the following effect: If an appointment from the artist is blocked by another existing contribution, the artist will not appear when searching for the corresponding date. Subject to change; the current calendar settings are stored in the info button in the calendar area.


7. Account
Data from the “Account” area is not displayed in the public profile and is only visible to the artist and Hall of Arts. This area is used to manage the business relationship between artist and Hall of Arts. Access to subscription management and billing overview is also located here.

8. Additional disclaimer
To the extent permitted by law, Hall of Arts assumes no liability for lost commitments, losses, or other damages caused by faulty functions or failures of the platform. This applies in particular to incorrect display of appointment status, misrepresentations in search results, or similar problems. Personal injury or cases in which Hall of Arts gross negligence is proven are excluded.
If services have already been paid for, the subscription fee will be refunded or credited for the downtime period, to the extent permitted by law. Further claims for damages are excluded.


9. Free basic services
The purpose of Hall of Arts' service is to provide a free profile. Free artist profiles are provided voluntarily. There is no right to maintain or continue this service.


10. Paid premium profiles/subscriptions
The purpose of Hall of Arts' service is the provision of paid premium subscriptions and paid functions such as the Booster. The detailed services and fees for premium subscriptions can be found in the current service and price overview.

11. Premium ranking and restrictions
Premium providers are shown prioritized in search results when they reach a specific match with the search query. The level of agreement is defined by “Hall of Arts” and can be changed at any time. The ranking algorithm can be changed at any time. A specific position in the ranking is not guaranteed. The number of premium providers shown per search query is limited. The most frequently liked posts are highlighted in the “Superstars” category on the homepage or in “Top 10 Artists of the Week.” Prioritized highlighting can also be purchased through the paid “booster function”.
